THE ENERGY ROOM
A PRIVATE MEMBERSHIP ASSOCIATION
Effective Date: December 14, 2025
1. SCOPE AND ACCEPTANCE OF TERMS
These Terms of Service govern your use of The Energy Room website, including browsing and access to our online booking portal. By accessing or using this website, you acknowledge that you have read, understood, and agree to be bound by these terms.
IMPORTANT: These Terms of Service are supplemented by and subject to the separate Private Membership Association Agreement, which must be signed before you may access any services or attend events. In the event of any conflict between these Terms of Service and the Private Membership Association Agreement, the Private Membership Association Agreement shall control with respect to services and events.
2. PRIVATE MEMBERSHIP ASSOCIATION STATUS
The Energy Room operates as a Private Membership Association (PMA) under the rights of freedom of association as guaranteed by the First and Fourteenth Amendments to the United States Constitution. Membership is a privilege, not a right, and is extended only to those who sign a Private Membership Association Agreement.
As a private organization:
2.1 We reserve the right to accept or deny any membership
2.2 Our services are provided exclusively to members within the private domain
2.3 Members waive any claim to constitutional, statutory, or regulatory protections that would otherwise apply in public commerce
2.4 The relationship between The Energy Room and its members is governed by the Private Membership Association Agreement
3. MEMBERSHIP ELIGIBILITY
3.1 Membership is available to individuals of all ages
3.2 For individuals under 18 years of age, a parent or legal guardian must complete and sign the Private Membership Association Agreement on their behalf
3.3 All members aged 18 and over must personally complete and sign a Private Membership Association Agreement before accessing services or attending events
3.4 By signing the Private Membership Association Agreement, you affirm that all information provided is true and accurate
3.5 The Energy Room reserves the right to deny membership to any prospective member without providing a reason
4. MEMBERSHIP FEES AND PAYMENT
4.1 One-time lifetime membership fee: $15.00 (non-refundable)
4.2 The membership fee may be paid and the Private Membership Association Agreement may be signed through our Wellness Living booking portal or in person at our front desk
4.3 Payment of the membership fee grants you the ability to book and pay for services and events through our booking portal
4.4 All services and events require separate payment at the time of booking (pay-per-service model)
4.5 Membership fee does not include complimentary services; all services are subject to additional fees
4.6 You must have a signed Private Membership Association Agreement on file before you will be permitted to receive services or attend events
5. ONLINE BOOKING AND APPOINTMENTS
5.1 All services are provided by appointment only
5.2 Appointments may be booked through our Wellness Living booking portal or by phone
5.3 When booking through our portal, you will be asked to create an account with Wellness Living
5.4 You may book an appointment through the portal without having signed the Private Membership Association Agreement
5.5 Payment for services is required at the time of booking or prior to service delivery
5.6 You will not be permitted to receive services or attend events until you have a signed Private Membership Association Agreement on file, either completed through the booking portal or signed in person at our front desk before your scheduled appointment
5.7 If you arrive for your appointment without a signed Private Membership Association Agreement on file, you must sign one at the front desk before receiving services
5.8 For individuals under 18 years of age, a parent or legal guardian must be present to sign the Private Membership Association Agreement on their behalf
5.9 Our booking portal is provided by Wellness Living, a third-party service. You acknowledge that Wellness Living has its own terms of service and privacy policy, which you agree to by using their platform. The Energy Room is not responsible for Wellness Living's performance, data handling, or service availability
6. CANCELLATION AND NO-SHOW POLICY
6.1 You must provide at least 24 hours' notice to cancel or reschedule an appointment
6.2 Failure to provide 24 hours' notice may result in forfeiture of payment for that appointment
6.3 Repeated no-shows or late cancellations may result in restricted booking privileges or termination of access
7. REFUND POLICY
7.1 The $15.00 membership fee is non-refundable under any circumstances
7.2 Payments for services are non-refundable except as required by law
7.3 Refund requests must be submitted in writing and will be considered on a case-by-case basis at The Energy Room's sole discretion
8. MEDICAL DISCLAIMER AND INFORMED CONSENT
IMPORTANT: THE SERVICES PROVIDED BY THE ENERGY ROOM ARE NOT MEDICAL TREATMENTS AND ARE NOT INTENDED TO DIAGNOSE, TREAT, CURE, OR PREVENT ANY DISEASE OR MEDICAL CONDITION.
By using this website and accessing services, you acknowledge and agree that:
8.1 The Energy Room and its practitioners do not practice medicine and are not licensed medical professionals
8.2 Services offered are for educational, spiritual, and wellness purposes only
8.3 Services are not a substitute for professional medical advice, diagnosis, or treatment
8.4 You should consult with a qualified healthcare provider before beginning any wellness program
8.5 You will not discontinue or modify any medical treatment or medication without consulting your healthcare provider
8.6 You are solely responsible for your own health and wellness decisions
8.7 The Energy Room makes no claims, representations, or guarantees regarding health outcomes or results
8.8 Individual results may vary and are not guaranteed
8.9 You participate in all services voluntarily and at your own risk
9. ASSUMPTION OF RISK AND RELEASE OF LIABILITY
By using The Energy Room's website and services, you acknowledge and agree that:
9.1 You assume all risks associated with participation in services and events
9.2 You release, waive, discharge, and covenant not to sue The Energy Room, its owners, employees, contractors, and agents from any and all liability for injury, illness, or property damage arising from your participation
9.3 This release applies to claims based on negligence, breach of contract, or any other legal theory
9.4 You waive all claims you may have now or in the future against The Energy Room related to your use of this website or services
9.5 For individuals under 18 years of age, the parent or legal guardian signing on their behalf accepts all risks and provides this release on behalf of the minor
10. HEALTH AND SAFETY REPRESENTATIONS
By booking services, you represent and warrant that:
10.1 You will disclose all relevant health information as requested by The Energy Room
10.2 You will immediately inform staff of any discomfort, pain, or adverse reactions during services
10.3 You understand that you may discontinue any service at any time
10.4 For individuals under 18 years of age, the parent or legal guardian is responsible for providing all health information and making these representations on behalf of the minor
11. PRIVACY AND CONFIDENTIALITY
11.1 The Energy Room respects your privacy and will maintain the confidentiality of your personal and health information
11.2 Information collected through this website and booking portal will be used solely for booking management and service provision
11.3 We will not share your information with third parties except as required by law
11.4 By using our services, you consent to our collection and use of your information as described
11.5 You may request access to or correction of your personal information by contacting us in writing
12. ACCEPTABLE WEBSITE USE
When using this website, you agree to:
12.1 Provide accurate and truthful information
12.2 Not use the website for any unlawful purpose
12.3 Not attempt to gain unauthorized access to any portion of the website
12.4 Not interfere with or disrupt the website or servers
12.5 Not transmit any viruses, malware, or harmful code
13. TERMINATION OF ACCESS
The Energy Room reserves the right to terminate or suspend your access immediately and without refund for:

13.2 Providing false or misleading information
13.3 Failure to pay for services
13.4 Any reason deemed necessary to protect the integrity of the website or the safety of staff or other members
14. INTELLECTUAL PROPERTY
All content, materials, trademarks, and intellectual property on this website remain the exclusive property of The Energy Room. You may not reproduce, distribute, or use such materials without express written permission.
15. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
15.1 The Energy Room's total liability for any claim related to website use shall not exceed the amount paid by you for the specific service giving rise to the claim
15.2 The Energy Room shall not be liable for any indirect, incidental, consequential, or punitive damages
15.3 The website is provided on an "as is" and "as available" basis without warranties of any kind
15.4 Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you
16. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless The Energy Room, its owners, employees, contractors, and agents from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from:
16.1 Your use of this website
16.2 Your use of services
16.3 Your violation of these Terms of Service
16.4 Your violation of any rights of another person or entity
17. MODIFICATIONS TO TERMS
The Energy Room reserves the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting on this website. Continued use of the website after changes constitutes acceptance of modified terms. We will notify users of material changes via email or posted notice on the website.
18. SEVERABILITY
If any provision of these Terms of Service is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining terms remain in full force and effect.
19. RELATIONSHIP TO PRIVATE MEMBERSHIP ASSOCIATION AGREEMENT
These Terms of Service govern your use of this website only. Your rights and obligations regarding actual participation in services and events are governed by the separate Private Membership Association Agreement. You must sign the Private Membership Association Agreement before you will be permitted to receive services or attend events. The Private Membership Association Agreement may be signed through the Wellness Living booking portal at the time of booking or in person at our front desk. In the event of any conflict between these Terms of Service and the Private Membership Association Agreement regarding services or events, the Private Membership Association Agreement shall control.
20. GOVERNING LAW AND DISPUTE RESOLUTION
20.1 These Terms of Service shall be governed by the laws of the State of Florida without regard to conflict of law provisions
20.2 Any dispute arising from these terms or your use of this website shall be resolved exclusively in the state or federal courts located in Palm Beach County, Florida
20.3 You waive any objection to venue or jurisdiction in these courts
20.4 You agree to attempt good faith mediation before initiating litigation
21. ENTIRE AGREEMENT
These Terms of Service constitute the entire agreement between you and The Energy Room regarding your use of this website and supersede all prior agreements and understandings. These Terms of Service are separate from and supplemented by the Private Membership Association Agreement.
22. WAIVER
The failure of The Energy Room to enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
